What are illegal vapes?

The Regulations cover single use e-cigarettes that contain nicotine and refillable e-cigarettes.

The Regulations state that e-cigarettes / vapes containing nicotine can only have a tank size no greater than 2ml in capacity.

This 2ml capacity allows the device to provide approximately up to 600 puffs although some newer devices can provide more than 600 puffs on a 2ml tank.

All disposable vapes containing nicotine that have single pods larger than 2ml would be illegal. The best method is to check the side of the packaging the device comes in. If the tank size is greater than 2ml then the vape cannot be sold in the UK.

The packaging must also be labelled correctly with “This product contains Nicotine, which is an addictive substance” if the product contains nicotine.

Single use products must not have a strength greater than 20mg/ml and carry the appropriate safety warnings for the strength of the nicotine product.

E-liquids containing nicotine

These must not be in containers larger than 10ml, multiple packages of 10ml containers are permitted.

The outer packaging and bottle must have the health warning “This product contains nicotine which is an addictive substance”.
