We are consulting on a draft Flood and Water Management: Land Drainage Enforcement Policy which will provide supplemental guidance in the context of specific requirements arising from the Flood and Water Management Act 2010 and the Land Drainage Act 1991.

Why your views matter?
Anyone who owns land adjoining, above or with a watercourse running through it have certain rights and responsibilities. In legal terms they are ‘riparian owner.’ If anyone who is a riparian owner do not carry out their riparian responsibilities, enforcement action may be taken by the Council to rectify any unlawful and/or damaging works on an ordinary watercourse.
The draft policy outlines a risk-based and proportionate approach to enforcement action, taking into account a number of factors underlined in the draft Policy. This consultation aims to ensure that all those that may be subject to Flood and Water Management: Land Drainage Enforcement Policy have their chance to comment on it before it is adopted.
